> A federal judge denied xAI's motion to dismiss a Clean Air Act suit over gas turbines at its Colossus data center near Memphis.

A federal judge has denied xAI's motion to dismiss a lawsuit brought on behalf of the NAACP by the Southern Environmental Law Center. The suit alleges that xAI, now owned by SpaceX, ran gas turbines at its Colossus data center near Memphis, Tennessee, without the permits the Clean Air Act requires. Plaintiffs say at least 35 combustion turbines and other pollution sources were installed and operated without the necessary preconstruction or operating permits.

xAI argued that the turbines are mobile and therefore exempt from permitting, that the plaintiffs lack standing, and that the citizen-suit provision of the Clean Air Act is unconstitutional. Judge Debra M. Brown rejected each argument: she found the plaintiffs have statutory standing, that the turbines are not "mobile sources" under the applicable State Implementation Plan, and that the citizen-suit provision does not violate Article II or the private nondelegation doctrine.

A separate motion to dismiss filed by the Department of Justice was denied earlier this month. The ruling lands as data centers become a political issue in the US, including a new moratorium on data center construction in New York.
